CAMS continues with Team Dynamik inquiry
CAMS Press Release 9 Sep 2004 The Supreme Court of Victoria this morning rejected Team Dynamik’s application for an injunction to delay today’s Stewards’ inquiry into alleged breach of regulations relating to V8 Supercar testing, confirming that the matter must be dealt with under the CAMS’ judicial system. The Supreme Court also ordered that Team Dynamik pay CAMS’ costs. Update (Sat 11 Sep 10:30 AM): The inquiry is continuing. The Stewards’ inquiry into Team Dynamik’s alleged breaches of the regulations relating to testing as set out in the 2004 AVESCO Operations Manual commenced this morning at 10am as scheduled at Sandown International Motor Raceway. Supreme Court Judge Mr Philip Cummins rejected the injunction application on the basis that the parties have voluntarily agreed to a judicial system which is designed to ensure legal technicalities are minimised, and it is premature for the court to intervene, particularly when the proceedings had not even started. Furthermore, it was decided that the material involved in the case is a matter for the experts in the area, being the Stewards appointed to conduct the inquiry. Justice Cummins commented that while there are serious matters involved in this particular case there is nothing in the context of the rules or the case to warrant the court interfering. Confederation of Australian Motor Sport President Mr Colin Osborne said this morning: “CAMS is pleased that the Supreme Court of Victoria has reinforced the sports authority over its own judicial system, and confirmed that all avenues of the CAMS judicial system must be exhausted prior to any party being able to seek the transfer of any matter to the civil law jurisdiction. “All participants pursuant to the rules in the AVESCO Operations Manual agree, through their entry into the Championship, that they will not become a party to any suit at law against the FIA, CAMS or AVESCO or TEGA until all remedies allowed by these rules have been exhausted. “Put simply, participants in all CAMS motor sport agree to abide by CAMS’ judicial system prior to entering into a court of law. “This is consistent with the Federation Internationale de l’Automobile’s (FIA) International Sporting Code which CAMS, as the sole National Sporting Authority for four wheeled motor sport in Australia, is responsible for regulating.” The Stewards inquiry was still in progress at time of release. |

Breach D1 (unauthorised testing) $72,000 Breach C13.10.2 (control tyres) $15,000 Breach c14.11.2 (Sensors) $15,000 Breach E6 (Transporter Identification) $2,000 Breach D1 is the max. penalty that can be imposed for that Rule. |

How much is a win at Bathurst worth for a team? I would say that it could be worth it for a spot of illegal testing there.

They qualified 24th and 27th, will start tomorrow.
I reckon FPR, HRT, Shell or one of the othe big dollar team could now decide that witha week or two till Bathurst or withthe championship ona knife edge,they might want to pay the $100K and go testing. Well it seems TEGA and Dynamic and both appealing, so it could go both ways from the sounds of things. Either the penalties will be bigger or possibly diminshed.
I wonder when the appeal will be held. Hopefully pretty soon and not the days leading up to Bathurst. dave |

Team Dynamik fined for testing rule breaches CAMS Press Release 11 Sep 2004 A CAMS Stewards' inquiry today found that V8 Supercar entrant Team Dynamik was guilty of a number of breaches of regulations relating to V8 Supercar testing as set out in the 2004 AVESCO Operations Manual. The Stewards imposed a penalty of $50,000 USD (approximately $72,000 AUD) with regards to breaches of V8 Supercar testing regulations. Stewards imposed a further penalty of $32,000 AUD in relation to other related breaches. The breaches took place at a remote airstrip in South Australia on Friday 20 August and Saturday 21 August 2004. Stewards have received notice of intention to appeal from Team Dynamik and TEGA. The appeal date has yet to be confirmed. |

I would think thats the rules ! I think you will find there is a red team with a 3 seater gaining miles, GREY area too, and overseas 4 post rig testing has been happening, so lets not get carried away that these teams are all clean cut, as you have seen with 2 other high profile cases it's only cheating if you get caught & if you get publicly penalised... |

if you can find where a 4 or 7 post rig is banned ,or even made mention of then i would like to see where, same with the 3 seater,different motor,tyres and weight.

So what do you have to do in this series to get more than a waggle of the bureaucratic finger????? To me that's the sheer lunacy of having prescribed maximum penalties in the first place... I would have thought "illegal testing" would be one of the more contentious issues and the fine would be enormous. $72,000. Hardly a penalty at all is it? |

How much did HRT get fined for there crew member doing burnouts in the pits at EC ,after the race ? #) points each and 10k?
What about Romano getting -150points at PI last year ?,or maybe the year before |

The appeal will be heard next Thursday...........
Kieran Wills * the data collected was not for Team Dynamik* - they were testing some other product.It's scientific research for a PATENT for another company with nothing to do with v8 supercars. This product is potentially worth mega $$$$ and the trucks were disguised so as not to give away this other company. Announcment to be made next Thursday on this. Wills says that the team is in finanacial trouble because of bad debts and the fine will hurt. Basicly it was a secret test for a PATENT and AVESCO were not invited so to keep the *thing* secret. He copped a fair hit from the press at the press conference. |

Oscar denied it was a registered v8 supercar until they took the tape off the roll bar.(with Mr Manson at Woomera) This car was in the wind tunnel at Monash on the 12th of May.(not sure what this means) Fair bit of other stuff as well which I have not covered. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ ok this is me talking - I think Oscar must be involved in this new secret product that needs the patent. WTF is it?? |
