Tobacco Advertising and British F1 teams

The nub of this is that new British legislation, due to come into force in the middle of 2005, has potentially grave implications for teams located in Britain.

The new law would see the promotion of tobacco on their cars anywhere in the world, liable to prosecution, if those images are shown in the UK. In other words in theory if BAR ran BAT livery in a country that allowed tobacco advertising, yet the race was shown in the UK, BAR could be prosecuted.

This has inevitably started team bosses financed by tobacco, musing over looking at relocating from the UK, to avoid potential prosecution in the future.

Whether the actual legislation would be implemented in that form, who know's, and as ever it may be the usual knee jerk that we see at the first whiff of trouble.

However the timing is slightly unfortunate, with Bernie on the offensive over Silverstone, and JYS and other's lobbying the government on the knock on effect that losing the GP would have on the UK motor racing industry, this piece of legislation only gives power to BE's argument that Europe (and the UK in particular) and F1 are not on the same wavelength any longer.

This is a red herring,as it only applies for the 18 months or so between the EU ban and the worldwide WHO ban in 2006. AFAIK ALL of the countries currently holding or planning to hold motor racing will have implemented bans.

Would this only apply in the UK? Or throughout the EU? I can't see Ferrari being prosecuted in Italy for showing one of their cars with Marlboro on it.

That's true, although it is likely that the recent/proposed new additions to the calendar will be the last to actually enforce it and are more likely to grant an exception for F1. Although country's may sign up to WHO, they still have to create their own national legislation to enforce it.

China, for example, is not very likely to enforce a tobacco advertising ban, having only just achieved a Grand Prix, whereas Europe is more politically sensitive to this issue and not easily grant exceptions.

"The WHO anti-tobacco treaty is making progress but in order for it to be effective each national government has to have its own legislation. This is going to take time and so if the tobacco companies do not police themselves as they are committed to do, it could take until 2015 or even 2020 for a global ban to be truly effective"

TV business news this morning speculated that B.A.R might have to relocate their operations to Japan due to Tabacco pending legislation!...That might suite Honda! Especially if British American Tabacco (who OWN not just sponsor B.A.R) sell out to Honda in the future?

As B.A.T. own the major stake in B.A.R perhaps they don'r actually need to advertise their brands on the cars?...afterall what else would they do with their vast profits...they could give it to the government in increased tax!?...What better than owning a racing team!...God bless em I say!

Persoanlly I believe this is a total red herring. The F1 teams wnat to move out of the UK and Europe because they can make a quick buck in Asia and the middle east.

You'd think motor racing never took place before tobacco sponsorship.

The WRC, LM, IRL, NASCAR, DTM, ETCC etc. seem to cope well with the various tobacco bans around the world.

Together with the the threats against Euro races, I am sick to death of the F1 establishment dumping on the fans who have put the sport were it is today.

Personally I hope all the British and Euro F1 teams leave for Aisa and the middle east, and eventually go bust when the F1 dream enivitably goes belly up.

F1 should shove off and let European motorsport get back to its roots.

Spending two dollars to save one has never made much sense.

When they say 'based' in the UK, what does that mean? Can they have the factory there and have HQ 'based' in a Monaco hotel room?
