For tax purposes, there is a difference between a capital loss and an operating loss. A capital loss is usually only available to reduce a capital gain. Interestingly, some REC holders have made a nice side business out if buying and selling transporters over the years, and other capital equipment, such that perhaps these can be offset against the alleged new capital gains event involving their share sale.

There are a couple of operations that are likely to have carried forward operating losses, either as a result of a financial shuffle to aid group taxation liabilities, or more likely, where investment unfunded by sponsorship income has been put into the legal entity to secure a new facility, new equipment, new cats etc.

There are currently 18 REC holders, each with a different financial strategy, purchase price, retained profit/accumulated losses, capital investment, operating asset base, and more obviously.. Ontrack performances

Note that some teams hold their RECs/licences in different companies than the operating race team. eg. DJR, LDM. So there would be no losses from the team.

There is no doubt the Tax Office will be taking a close look at this, big numbers like $300million get the pretty interested in their cut!
