Interesting that Longhurst still has BP (nee Castrol) connections from when he used to be with Larry AND LG connections from when he was with Briggs.
Maybe we will see Benson and Hedges in Shanghai on the #45 car |

Interestingly, I was watching a news show yesterday morning and a reporter who has been based over there since the start of the proceeding against Corby, spoke to other Australian reporters over there who had also been covering the story since the start and 8 of them believe Corby was guilty! They heard all the proceedings.

my wife flies to dempasar on sunday and i can tell you i'm taking home a whole roll of shrinkwrap from the factory downstairs for around her bags! apperently under indonesian law ownership is like 100% - if you say yep thats my bag it doesnt really matter whats in it because you just claimed ownership which is what shapelle did. we're ready for that - all my wife necesseties will be in her carry onbut if her suitcase looks compromised on the carasel she will just walk away - how tragic is that in this day and age? and we fight here over whether skaife had the corner or not??

There are reports of people video taping the opening of thier luggage at the departure gate at Melbourne airport, filming the contents and the hand over process to cover their backsides if the get done Sharpelle style in Bali.

This was actually discussed yesterday on TV (ABC) with an Australian Legal Expert on Indonesian Law, and he said that was a crock of ****, there Laws are the same as ours, Innocent until proven guilty, and she was found guilty based on the evidence given in their court of law before 3 Judges.

most have said that under western law there would be sufficient doubt given that the bags up to and including when they were opened were not in her posession for approximately 6 hours. They do not recognise resonable doubt in Indonesia, and i have heard others say that the fact that her fingerprints were not on the bag of dope should have gotten her off but her defence team made virtually nothing of this fact. A reckon the QC's will put up a better fight for her

The case of importing narcotics was found to be proven by the prosecution. ie the marijuana was in the bag and she admitted she owned the bag. This was ALL the prosecution had to prove. Once the charge of importation was proved, all other charges were ignored as importation was the highest charge and under indonesion law if the highest charge is proved the lesser charges do not need to be dealt with.
The Indonesian legal system does not include the concept of "reasonable doubt", therefore in order to beat the charge the defence needed to PROVE that somebody other than Shappelle put the marijuana in her bag. They were not able to do this. The fact that the victorian prisoner testified that he overheard a conversation about drug barrons arranging for the marijuana to be placed in a passengers bag by baggage handlers at the airport is heresay NOT proof. IF her three bags had been weighed together at Denpasar airport as they were at Brisbane they MAY have been able to prove a weight discrepancy. But the bags weren't weighed together so therefore this is irrelavent to the court (remember no reasonable doubt). IF the bag containing the marijuana had been fingerprinted by Indonesian police they MAY have been able to show that Shapelles fingerprints were not on the bag, or they may have been able to match fingerprints to a baggage handle, but no fingerprinting was done so again this irrelavent to the court. (no reasonable doubt). With the evidence presented there was no way that any verdict other than guilty could have been handed down. Legal systems work on proven facts and can not be swayed by emotion or the entire system collapses. I feel incredibly sorry for Shappelle, my gut feeling is that she had no part in the importation but the only way she can get out of this mess is for the baggage handler(s) to admit to putting the marijuana in her bag or for them to be caught and charged by Australian authorities. Without this happenning I fear any appeal will not succeed. |

Thanks for that summary bestfit.
Better than anything I've heard or read in the media so far. IMO opinion our media has done a pretty rubbish job in reporting the emotion rather than the facts in this case. I include aussie channel 9, which we get, in this. What do you Australians think? btw, I guess this is a parc ferme thread in nature, but it's a pretty localised story, so here's just as good i reckon |
