I think ? that it's something to do with the aperture size however I would very much doubt that the "powers that be" that patrol the roads would do anything about it. But in a point of law an insurance company might "wriggle" out of a case as they often do on a technicality

I think they're designed/built differently for impact/road rash etc. bike helmets are often heavier
