The question is, did the general manager of the operating company know the regulations when he allowed the activities above the level permitted by the planning agreement to take place, indeed events he was active in planning and promoting?

If he did, he is responsible for the situation, if not, he's incompetent as he should have know.

In either case, I'd suggest that deciding to employ him would be harmful to a business.
