I think that counts as 'evidence', or perhaps the law has changed recently..

I don't know what the MSAs take on all this is as re road licence bans. Although I have been breathalized twice at two race circuits over the years, but I believe by the sports council ?

They have no evidence that I was in control of the car at that point, I was unconscious by then, I would have fought it to the death if I was awake.

I have resigned myself to being banned. I can still test on the local airfield, get my car finished and bullet-proof before I race it. I am more worried about finding a job with no licence, especially in the car industry, its going to be hard. Or I maybe jumping the gun and the sheriff maybe in a good mood that day and give me community service or a fine without banning me!

Doesn't that make you 100% guilty of being asleep behind the wheel? And therefore they have lots of evidence that you were driving 'without due care and attention'.

Try appealing against that and you'll be laughed out of court.
