Well, if they are cheating, then all the other teams are cheating too. All front wings (and rear wings etc) flex to some degree. Which breaks regulation 3.15 (but maybe not 3.17), the regulation that basically says that aero has to be rigid. Maybe some are just cheating more than others.

What's needed is a more stringent test or the other teams to get with the programme.

But Ferrari were then clearly breaking rule 3.15. There was no wing flex test then (no rule 3.17, which was no doubt brought in because of Ferrari's front wing), so visual evidence was all that was needed.

The FIA probably got fed up of watching boring videos of moving carbon fibre and so, instead, decided to implement some tests.
