Fair call on the Due Dilligence, but its a case of who approached who? If a super model ask you out, would you say no? Someone says I'll give you sponsorship, you go "Thank God" - then start to panic when the money isn't in the bank account as promised and you've painted the cars, transporter, team merchandise etc etc.

I've heard of cases where the car/transporter has been painted in the sponsors colours in a bid to woo them to sign the deal

It would be a very grey area, but likely covered by some retail price maintenance provisions.. all depends on the reasons given for shortage of supply.

Also brought some interest from various state trade practices legislation regarding advertised product not being available when promised too

From my limited retail knowledge, as far as I'm aware a company is well within its rights if they feel a retailer is damaging their brand through loss leading.

Most forms of exclusive dealing are only prohibited if they have the purpose or likely effect of substantially lessening competition in a market.
Third-line forcing: A type of exclusive dealing, third-line forcing involves the supply of goods or services on the condition that the acquirer also acquires goods or services from a third party. Third-line forcing is prohibited per se.
Resale price maintenance – fixing a price below which resellers cannot sell or advertise
Mergers and acquisitions that would result in a substantial lessening of competition
A priority of ACCC enforcement action in recent years has been cartels. The ACCC has in place an immunity policy, which grants immunity from prosecution to the first party in a cartel to provide information to the ACCC allowing it to prosecute. This policy recognizes the difficulty in gaining information/evidence about price-fixing behaviours.

This exemption does not apply to genuine clearances, or to when a supplier has agreed to supply goods to a company for the purpose of loss leader selling.

And as an 'in and out' case, the Caltex brand is to slowly disappear over the next 3 years, to be replaced by Ampol:
