Dumbrell appeal upheld
The V8 Supercar National Court of Appeal convened this evening at the CAMS National Office in Melbourne to hear an appeal lodged by Team Perkins Motorsport Pty Ltd, with regard to the incident between Paul Dumbrell and Cameron McConville during race two at Clipsal 500 Adelaide on Sunday 21 March 2004.
The appeal by Team Perkins Motorsport Pty Ltd, on behalf of Paul Dumbrell, was against the finding of the Stewards that Mr Dumbrell was in breach of the Rules, failing to exercise reasonable care in attempting to overtake. After reviewing all evidence, the Court upheld the appeal. The penalty of a loss of 75 Championship points and a $10,000 fine was withdrawn. The $10,000 appeal fee will be refunded in full. |

That is a terrible decision from the appeals board and now discredits them fully. |

I actually think letting him off is a fair call.
If there had only been the Dumbrell and McConville at that section of the track, McConville would have hit the wall but the damage might not have been so bad. It was just highly unfortunate that Johnson, Jones and Frosty were trailing so close and the ensuing carnage prevailed. It doesn't matter what they do to turn 8 at Adelaide, it's always going to be risky. Until they have permanent yellow flags there, accidents will happen ... |

I just wonder whether they proved Dumbrell innocent, or like an appeal last year, just showed there was insufficient evidence... Cheers |

I would like to see the full transcript of the appeal verdict - considering how the stewards were mauled in December over procedural stuff ups and one virtually accused of falsifying evidence - I am wondering if the stewards have really learnt anything or still appear to be blindly going down the same path as before.

What and absolute joke, this has turned the sport into a joke. Paul Morris gets a black flag for turning Murph around ( just touched him ), and Dumbrell gets nothing for a incident that was dangerous and was worse then Pauls.

Well it certainly clarifies what is acceptable and what isn't
From memory ,would it be fair to say then that it was judged a racing incident then as he didn't get a drive through at the time either did he. Looks like things will have to be sorted out on the track at some time in the future,oh goody |

Now if Russell had done that he would be out for 3 rounds.......
Some unbelievable stuff has been got away with at the Clipsal... Morris on Jones Bright on Luff Dumbrell on McConville Skaife on Lowndes (ok, there was oil envolved but basically he did hit him in order to pass him). |

I agree with the list that 00 XR8 said, except for Skaife on Lowndes.
The oil being on the track really changes everything. |

Looks like another year of no consistancy. The fact is that PD stuck his nose up there at 200 or so kays and 'just' touched CM enough to turn him around.(i cant remember if CM cut across his nose or not, but still a very risky move on pauls behalf. Fair enough 10k and 75 points may be a bit harsh but to let him off leaves a little to be desired IMHO.

The data doesnt lie. I understand CPR have the on-board data to support that Dumbrell lifted off and braked to try and get out of the incident... so that should have been a mitigating circumstance.
It suggests that any verdict made on the race weekend can be overturned on appeal if you find the holes in the process. (Note to Rusty, go out of your way to make the wrong person notify you of a breach next time you are in the stewards room... you will get off on a technicality!) |

You brake or lift for that corner anyway GTRMagic.
Whether he tried to get out of it or not, he stuck his nose in where it shouldn't have been. Only one car can go through there at a time and everyone knows that. I like Paul as he gets in and gives it a red-hot go, but he was clearly in the wrong with that move. The initial punishment was probably a bit harsh, but to label him blame-free is surely a case of leg-pulling. |

I dont think he is blame free at all, more that it was an acciden... Dumbrell has done some seriously boneheaded things, and from some viewpoints this is likely another of them...
....but there is obviously some fault in the adjudication process if a driver is charged at the circuit by the controllers of the day, only to see a different group overturn the original verdict.... |

AS I have said before - read the proceedings of Skaifes Appeal back in December (link is found on RaceNews) - and see what they have to say about the shoddiness of the on track stewards procedures.

Let's face it - no one in here knows the facts of the appeal - so all these calls about the appeal being overturned being wrong are pure speculation and sour grapes.
