rush1 should be qualifying in the top 10 on the grid
Greg Ray to sue everyone

He is on a rampage. First Foyt will be sued (next time sign an actual contract Greg) and possibly Tom Kelly and ex-sponsor Trim Spa in the future.

its a shame when motorsport gets dragged into a courtroom.

if its all true then i say good luck to him but i dont know the full details so you just gotta say let the courts sort it I guess.

While actually signing a contract is a good idea, verbal contracts are legal & binding in Texas. You just need a witness or tape recording to prove it. Does Greg have that?

Talking about it here could prejudice the chances of the case getting a fair hearing.

Verbal contracts are legal in most US states, but its very difficult to enforce such a contract when you have conflicting stories. He should have a witness or recording, I guess we shall see. Greg Ray is not some 21 year old kid.

I wonder on what grounds he would sue Tom Kelly and Trim Spa?

Also how can informed discussion based on public documents possibly be a contempt of Court? Has Texan censorship gone that far?

Plus you don't even (necessarily) need witnesses to an oral agreement. The fact that the parties conducted themselves as if there was an agreement can be deemed a contract. And Greg Ray driving a Foyt ****box will not be considered someone does gratuitously; even if there were no formal agreement as to salary Ray would be entitled to a reasonable sum.

Am guessing Foyt will counterclaim on the basis that Ray did not bring sufficient sponsorship and therefore Ray was in breach. And that Foyt's damages exceed those due to Ray.

I can't believe Foyt is naive enough not to have a contract with his drivers and I can't believe Ray is dumb enough to drive without a written one.

Foyt foolishly contradicted himself by saying he didn't have a contract with Ray, yet said Ray "promised" Foyt certain amounts of sponsorship. Gee, sounds like a contract to me.

Surely you should know that it's Tom KELLEY.

It seems like Greg may have a good case in real terms, but I suspect Foyt was smart enough to cover his back and ensure that nothing was recorded of the deal by anyone neutral, so he'd be unable to get recours. Maybe that succession of problems is what caused him to set up Access, cutting out the middleman.

Opinion evidence is inadmissible except from a suitably qualified expert, and only then with the Court's express permission. In this case opinion evidence is entirely useless - you need opinion evidence for e.g. personal injury cases to assess damage or a computer expert to determine if code was negligently drafted.
